New Presumed Conditions

Six Veterans organizations, including the named petitioner Military Order of the Purple Heart, have asked the U.S. Court of Appeals for the Federal Circuit to order VA to publish regulations adding ischemic heart disease, Parkinson’s Disease, and B-cell leukemias to the regulatory list of disabilities presumed to have been caused by Agent Orange exposure.  Secretary of Veterans Affairs Shinseki announced in October 2009 that the disabilities would be added, but the proposed regulations doing so have not yet been published despite a statutory deadline of February 19.  The organizations informed VA that they would commence litigation if the regulations were not published by March 12.  VA responded that it could not publish the regulations until it receives approval from the Office of Management and Budget, which is still reviewing them.
