Garnishment of VA Benefits

The Wall Street Journal reports that new Treasury Department rules will require banks receiving garnishment orders to check whether VA benefits have been deposited into the account within the past 45 days, and, if so, take steps to ensure that the amount of those benefits remains available for the recipient’s use.  Currently, many banks simply freeze the entire account when receiving a garnishment order, despite law barring creditors from attaching VA and Social Security benefits.  The recipient’s inability to access the VA and SSA benefits often results in overdraft fees.  See the article here:  http://online.wsj.com/article/SB10001424052748704479704575061702246038506.html?mod=WSJ_hpp_LEFTWhatsNewsCollection
